Qbox.com Privacy Policy

We respect the privacy of the users of our website (the "Website") and services (the "Services"). In this document we identify how we may use information of users. We also identify limits on those uses.

1. Data That We Gather About Users

a. Voluntarily Submitted Data

When you sign up for Qbox.com Website and Services, we ask you for information such as email address, account password, and a nick name. For better experience of our services, we also offer you an option to provide more information (such as personal photo image, your MySpace or Blog URL, your country or location of access, date of birth, or gender). However, we do NOT ask for social security number, driver’s license number, state identification card number, bank account number, credit or debit card number, or mailing address.

While using the Website and Services, you may choose from time to time to provide us with your music listening data stored on your computer in an XML format or any other computer readable format that were created by third party programs. This may be done by clicking buttons on the Website, a toolbar or stand-alone program. When you upload your music listening data, the data will be stored on the Qbox.com server computers and used for synching your music listening data on your local computer and that on the Qbox.com server computers.

b. Automatically Collected Data

When you use the Website or Services, Qbox.com servers automatically collect the following data:

  • server logs, including information such as your web request, Internet Protocol (IP) address, search words that you entered and date and time of your search request;
  • computer and connection information such as browser type, language, version, and timezone setting, browser plug-in types and versions, operating system, and platform;
  • the full Uniform Resource Locator (URL) clickstream to, through, and from our Web site, including date and time;

We may use software tools such as JavaScript to measure and collect session information, including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

c. User communications

You may choose to disclose your personal information to other users of our Website and Services. By disclosing your personal information, you may receive messages (i.e., email) from other users. You may also receive comments on your page from other users. Furthermore, we may provide tools for communication among users via our toolbar or stand-alone program (i.e., chatting).

d. Cookies

A cookie is a set of data stored on the user's computer tied to information about the computer. We use both session ID cookies and persistent cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the user's hard drive for an extended period of time. By setting a cookie on the Web Site, users would not have to log in a password more than once, thereby saving time while on the Web Site. If a user rejects the cookie, the user may still use the Web Site, but the user will be limited in some areas of the Web Site. Persistent cookies enable us to track and foster the interests of our users to enhance the experience on the Web Site. We may also use Flash cookies (also known as Flash Local Shared Objects), or similar data on certain parts of our Website for fraud prevention and other purposes.

2. Use of Collected Data

We use your information to operate and improve the Website and deliver the services or carry out the transactions you have requested. We also use your information to communicate with you. We may send certain service communications such as welcome letters, information on service upgrades or changes in the terms of use or privacy policy.

Personal information collected on the Website and Services may be stored and processed in the United States or any other country in which Qbox.com or its affiliates, subsidiaries or agents maintain facilities. By using the Website or Services, you consent to any such transfer of information outside of your country.

a. Voluntarily Submitted Data

We use voluntarily submitted data to authenticate user access and communicate via e-mail. ,

We may combine the information you submit with data automatically collected through your use of the Website or Services in order to provide you with a better experience and to improve the quality of our services. For certain services, we may give you the opportunity to opt out of combining such information.

We do not share this information with third parties except to use non-identifying and aggregate information to better design our web site and to provide our advertisers with aggregated data about the Websites and the Services.

b. Automatically Collected Data

We use automatically collected data to to understand users' music listening trend. We may also use general information about our users’ playlists to understand the musical tastes of our users.

We may provide third party advertisers with the users’ music listening trend and the musical tastes to direct certain types of advertisements to specific pages where users may have expected interest in the product.

c. User Communications

When you send email or other communications to us, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.

d. XML Files

The Website and the Services access XML files created by third party programs on your computer when you choose from time to time to synch local XML files with those on servers. We store the XML files on the Qbox.com servers and use the files to produce users' music listening preference data.

e. Cookies

We use cookies to improve the quality of our service by storing user preferences and tracking user trends, such as what music people like.

f. Log Files

Qbox.com servers use log files. They include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user's movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to individual information.

3. Sharing of Data

Information about users is an important part of our Website. Other than as set out in this Privacy Policy, we will give notice when information about you might go to third parties, and you will have an opportunity to choose not to share data.

We reserve the right to share aggregated information about users and users' music listening preferences with third parties. We also reserve the right to use the information for demonstration purposes on other public and test websites. This is not linked to any personally identifiable information.

We occasionally hire other companies to provide limited services on our behalf, such as handling the processing and delivery of mailings, providing customer support, hosting websites, processing transactions, or performing statistical analysis of our services. Those companies will be permitted to obtain only the personal information they need to deliver the service. They are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose.

4. Security

Qbox.com takes reasonable precautions in accordance with industry standards to protect our users' information.
When users submit information via the Website, their information is protected both online and off-line. All users' information is subject to restricted access in our offices. Only employees who need the information to perform a specific job are granted access to personally information.
You are responsible for ensuring that your contact information is current and correct. To review or change your contact information, go to the "My Profile" page on the Web Site. If users have any questions about the security at the Web Site, users can send an email to privacy@qbox.com.

5. Third Party Advertisers

Our site includes third-party advertising and links to other websites. We do not provide any personally identifiable customer information in breach of this Privacy Policy.
These third-party websites and advertisers, or Internet advertising companies working on their behalf, sometimes use technology to send (or "serve") the advertisements that appear on our website directly to your browser.
They automatically receive your IP address when this happens. They may also use cookies, JavaScript, web beacons (also known as action tags or single-pixel gifs), and other technologies to measure the effectiveness of their ads and to personalize advertising content.
We do not have access to or control over cookies or other features that they may use, and the information practices of these advertisers and third-party websites are not covered by this Privacy Policy. Please contact them directly for more information about their privacy practices.

6. Choices Users Have

You can always choose not to provide information, even though it might be needed to make full use of the Website and Services.

a. How to Turn Off Cookies

The Help portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Additionally, you can disable or delete similar data used by browser add-ons, such as Flash cookies, by changing the add-on's settings or visiting the Website of its manufacturer. However, cookies allow you to take full advantage of Qbox.com's coolest features, and we recommend that you leave them turned on.

7. Legal Disclaimer

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to: (a) comply with a current judicial proceeding, a court order or legal process served on the Website; (b) protect and defend the rights or property of Qbox.com (including the enforcement of our agreements); or (c) act in urgent circumstances to protect the personal safety of users or members of the public.

8. Business Transitions

In the event the Website or Services go through a business transition, such as a merger, being acquired by another company, co-branding a product, or selling a portion of its assets, users' personal information will, in most instances, be part of the assets transferred.

9. Correcting/Updating/Deleting/Deactivating Personal Information

If a user's personally identifiable information changes (such as email), we provide a way to correct and update users' personally identifiable information. This can usually be done at the "My Profile" page.

10. Notification of Changes

If we decide to change our privacy policy, we will post those changes to this privacy statement and other places we deem appropriate so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
If, however, we are going to use users' personally identifiable information in a manner different from that stated at the time of collection we will notify users via email and by posting a notice on the Web Site for 30 days.
